Marijuana Packaging: Who Actually Pays for Compliance?

A five-location multi-state operator and a single dispensary’s in-house cultivator both need their flower packaging certified as child-resistant. Both pay roughly the same lab fee to get it tested. Both wait through the same weeks-long certification process. Both face the same recall exposure if the packaging fails a re-test down the line.

The difference is what happens next. The MSO spreads that certification cost across tens of thousands of units sold every month. The single-location operator spreads it across a fraction of that volume. Same compliance requirement, same fixed cost, wildly different burden per unit sold.

That’s the part of the marijuana packaging conversation that doesn’t get talked about enough. Compliance costs aren’t really about the packaging itself. They’re about who can afford to make compliance disappear into their cost structure, and who can’t.

The Compliance Costs Everyone Pays the Same

Child-resistant packaging in cannabis runs on the same federal framework pharmaceutical and household products have used for decades: the Poison Prevention Packaging Act, enforced through the Consumer Product Safety Commission’s testing protocol at 16 CFR 1700.20. Packaging has to resist opening by real children in a lab setting, while still being usable by adults, before it can legally hold a regulated product.

Getting that certification isn’t free, and it isn’t cheap. Trade coverage from Cannabis Industry Journal has reported certification costs running into the hundreds of dollars per package type, with the process itself taking weeks to complete. If packaging fails a compliance re-test after it’s already on shelves, the same coverage puts recall costs anywhere from $25,000 to $250,000 per SKU, plus the risk of losing a license entirely.

None of that scales down for a small operator. A single-location cultivator testing three SKUs pays close to the same per-SKU certification fee as a multi-state operator testing thirty. The lab doesn’t offer a discount because the buyer is smaller. The testing protocol doesn’t get shorter because the business has less revenue behind it.

Why the Same Dollar Amount Hits Differently

This isn’t unique to cannabis. It’s a well-documented pattern across regulated industries generally, and it has a name: the fixed cost of regulatory compliance.

Research from the Small Business Administration’s Office of Advocacy has found that per-employee regulatory compliance costs run significantly higher for small firms than for large ones, in some sectors, more than double. The reason is straightforward. Much of what a business spends to comply with a regulation doesn’t change based on how much product that business actually sells. A certification fee, a testing protocol, a labeling redesign, these costs land the same whether a company moves a thousand units or a million. Large firms absorb that fixed cost across enormous volume. Small firms absorb the same dollar figure across a fraction of it.

Cannabis packaging compliance follows exactly that pattern. The certification fee doesn’t care about company size. The per-unit cost of absorbing that fee absolutely does.

Where the Gap Actually Shows Up

For a large multi-state operator, a packaging compliance cost that runs into the thousands of dollars is a rounding error, one line in a budget spread across dozens of retail doors and enormous production runs. For a small, single-location cultivator or processor, that same dollar figure can represent a real percentage of monthly operating margin.

That gap compounds in a few specific ways:

Volume pricing on the packaging itself

Beyond certification, the actual unit cost of compliant containers, closures, and materials drops as order size increases. Large operators negotiate better per-unit pricing simply by ordering more. Small operators pay closer to list price for the exact same compliant packaging.

The cost of getting it wrong

A packaging failure that triggers a recall is a survivable, if painful, event for an MSO with reserves and multiple revenue streams. For a business running on thinner margins and less cash cushion, the same recall can be existential.

Regulatory churn

State cannabis packaging requirements change multiple times a year, and operators typically get a narrow window, often 60 to 90 days, to adapt. Large operators have compliance staff dedicated to tracking those changes across every state they operate in. Small operators are often tracking it themselves, on top of everything else running the business.

Access to expertise

Large operators can afford in-house regulatory counsel or dedicated compliance staff who track packaging law changes as their full-time job. A small operator is more likely piecing together compliance knowledge from supplier guidance, industry forums, and whatever time is left after running day-to-day operations, a real information gap that compounds the cost gap.

What Small Operators Can Actually Do About It

The fixed-cost problem doesn’t have a perfect solution, but it isn’t entirely fixed either. A few things genuinely help narrow the gap.

Choosing stock over custom where it makes sense

Custom packaging usually means custom certification, a fixed cost paid once per unique design. A stock, pre-certified container that already meets 16 CFR 1700.20 lets a small operator skip that certification cost entirely for products where a fully custom look isn’t critical to the brand.

Working with a packaging partner that’s already done the certification work

Suppliers who maintain a library of pre-certified, compliant packaging spread their own certification investment across every client using that stock design, effectively passing along some of the same economies of scale a large operator would otherwise need to build in-house.

Prioritizing which SKUs actually need custom compliance work

Not every product line needs the same level of packaging investment. A small operator with limited compliance budget gets more value concentrating custom design and certification spend on flagship products, while using proven stock solutions for the rest of the catalog.

None of this eliminates the underlying disparity. A stock solution still costs a small operator more per unit than a large operator’s negotiated bulk pricing on the same item. But it does convert an unavoidable fixed cost into a smaller, more manageable one, which matters when the alternative is absorbing the full certification burden alone.

What This Means for the Industry

None of this is an argument against child-resistant or tamper-evident requirements. Those standards exist because they prevent real harm, and cannabis packaging should meet them without exception.

It’s a different argument: that “compliance cost” isn’t a single, evenly distributed number, and treating it that way obscures who’s actually absorbing the burden. A certification fee that barely registers for a large operator can be the difference between a good quarter and a bad one for a small business trying to compete in the same regulated market.

As cannabis packaging regulation continues to mature and tighten, that gap isn’t likely to close on its own. If anything, more frequent regulatory updates and stricter testing protocols raise the fixed cost of staying compliant, which raises the bar disproportionately for exactly the businesses with the least room to absorb it.

Understanding marijuana packaging compliance starts with recognizing that “the cost of compliance” was never really one number to begin with. It’s a fixed cost that lands very differently depending on the size of the business paying it.
