ACLU Looks To Reinstate Fired Walmart Employee Lawsuit
Joe | Apr 28, 2011 | Comments 5
In February a District Court Judge dismissed the lawsuit of Joseph Casias, the Michigan medical marijuana patient who was fired by Walmart for failing a drug test. Now the ACLU is asking the U.S. 6th Circuit Court of Appeals to reinstate Joseph’s lawsuit.
The argument goes to the heart of Michigan’s medical marijuana law and whether or not it protects patients in the workplace. A former Employee of The Year, Joseph suffers from a brain tumor and sinus cancer, but was fired by Walmart for testing positive for the cannabis he uses legally to manage his pain.
Not only will the case have reverberations in Michigan, but across the country as well. Precedents can set, and future medical marijuana bills will have sections about medical cannabis in the workplace based on this case.
We wish Mr. Casias good luck and will bring you updates on this story as they become available.

Sad to hear that Walmart hasn’t adapted to the local state law. I hope the best for Casias and Walmart will reconsider.
I have already quit shopping at China-mart. So here’s just one more reason to boycott.
Just one more reason to never shop at Walmart.
It is sad that Walmart is discriminating against Joseph for taking a legal medication that he needs and deserves.
I’ll keep shopping at Target, NO WALMART FOR ME!
Maybe I will stop going to walmart too as well as encourage others to do the same..step up w/me everyone and make a difference because if our state is to set the rules for this being put in stone theres no changing it later. If walmart claims to be as good a company as they think they are then why should they need a judge or anyone else for that matter, to tell them whats humanely proper. Maybe someone can start an event on facebook getting everyone to stop funding walmart until they grow up and start showing the compassion and leadership!
